These Terms of Use (ToU) govern the use of hosting services offered by the association VexCloud, located in Châteauneuf-sur-Loire, France, in accordance with the French law of 1901 governing associations.
Any use of VexCloud services implies unreserved acceptance of these ToU.
VexCloud hosting services are intended for legal use and in compliance with ethical and moral rules. The user agrees not to use VexCloud services for illegal, fraudulent or harmful purposes.
The following activities are strictly prohibited:
The user is responsible for all activity carried out through their hosting account and agrees to comply with applicable laws, rules and regulations.
In the event of abusive use or use contrary to these ToU, VexCloud reserves the right to suspend or terminate services without notice.
VexCloud services (VPS, dedicated servers, VPS reseller) are provided with fair-use bandwidth. No volume limit is applied under normal use.
In case of detected abuse — abnormal traffic, prolonged saturation or impact on shared infrastructure — VexCloud reserves the right to throttle the bandwidth of the affected service or apply additional charges corresponding to excess consumption.
The client will be notified before any corrective action, except in cases of technical emergency requiring immediate intervention.
VexCloud commits to taking the necessary measures to ensure the security of its hosting services. However, the user is also responsible for the security of their own data and applications.
VexCloud cannot be held liable for damages caused by intrusions, cyberattacks or malicious actions by third parties.
VexCloud reserves the right to suspend or terminate hosting services in case of non-compliance with these ToU, illegal activities or violation of third-party rights.
VexCloud cannot be held liable for damages resulting from a suspension or termination of services.
The user retains all intellectual property rights over their content and applications hosted by VexCloud.
By using VexCloud hosting services, the user grants VexCloud a non-exclusive license to host, reproduce and distribute their content for the purpose of providing the requested services.
VexCloud reserves the right to amend these ToU at any time. Users will be notified of changes through appropriate communication channels.
By continuing to use the services after the ToU have been amended, the user accepts the new terms.
In the event of a dispute relating to the interpretation, performance or termination of these ToU, the parties will endeavor to find an amicable solution.
Failing that, the dispute will be submitted to the competent courts in accordance with applicable legislation.
